The Islamabad High Court IHC has suspended the disqualification of PTI leader Umar Amin Gandapur. According to details, during the hearing of the case, the lawyer of Umar Amin Gandapur in his arguments said that no notice was given and the whole proceedings continued against Ali Amin and then issued the order against Umar Amin.
Omar Amin's lawyer said that after a summary inquiry, a fine of up to Rs 50,000 can be imposed and if there is a second violation, action can be taken. The court suspended the ECP's order disqualifying Omar Amin after arguments by lawyers. The Islamabad High Court said that the order of the Election Commission would remain on the field as far as Ali Amin Gandapur was concerned. Later, the court issued notice to the Election Commission seeking reply by February 11.
It may be recalled that PTI leader Amrameen Gandapur had challenged the disqualification decision. Imrameen Gandapur has filed a petition in the Islamabad High Court against the disqualification decision. According to media reports, the petition filed by Omar Amin Gandapur has named Election Commission, Chief Election Commissioner, Regional Election Commissioner and Senator Kamran Murtaza as parties.
The petition contends that the ECP failed to meet the requirements of transparency, the law should have given the benefit of the doubt to the candidate, and without a summary inquiry, the code of conduct could not be violated. The petition said that the Election Commission had declared Umar Amin Gandapur ineligible for the post of City Mayor of DI Khan.
The petition states that there is no complaint on the record of being a resident of any of the constituencies of the complainant. Amrameen Gandapur said that the allegations made were vague and general in nature and without any specific details, the provisions of section 234 of the Election Act 2017 were misused.
It may be recalled that yesterday, the Election Commission had disqualified Umar Amin Gandapur, brother of Federal Minister Ali Amin Gandapur and a local body candidate. The Election Commission has ruled in the case of Ali Amin Gandapur for violating the code of conduct for local body elections. While the Election Commission disqualified Ali Amin Gandapur's brother Umar Amin Gandapur and barred Federal Minister Ali Amin Gandapur from participating in the local body election campaign.
