ISLAMABAD The Islamabad High Court has given a safe verdict on the petitions of Ali Amin Gandapur and Shah Mehmood. Islamabad High Court Chief Justice Athar Minallah ruled on the petitions. ISLAMABAD: The Islamabad High Court IHC has rejected the plea of Umar Amin Gandapur.
The notification issued by the Election Commission against the disqualification of Shah Mohammad was declared null and void. Omar Amin Gandapur was also allowed to contest the election. The Islamabad High Court declared Umar Amin Gandapur eligible to contest the mayoral election. It may be recalled that the Election Commission had declared Umar Amin Gandapur, brother of Federal Minister Ali Amin Gandapur, ineligible for the post of City Mayor of Dera Ismail Khan, which he challenged in the Islamabad High Court.
Omar Amin had also filed a miscellaneous petition seeking annulment of the decision of the Election Commission, in which it was requested to fix the petition for immediate hearing. The petition also named the Election Commission, Chief Election Commissioner, Regional Election Commissioner and Senator Kamran Murtaza as parties. The Election Commission failed to meet the requirements of transparency. Violations of the Code of Conduct cannot be considered.
During the hearing of the case in the High Court, the lawyer of Umar Amin Gandapur in his arguments said that no notice was given and the whole proceedings continued against Ali Amin then the order was issued against Umar Amin. Omar Amin's lawyer said that after a summary inquiry, a fine of up to Rs 50,000 can be imposed and if there is a second violation, action can be taken. The High Court said that the order of the Election Commission would remain on the field as far as Ali Amin Gandapur was concerned.
